Terms of
Service.
The terms governing use of this website and engagement of the professional services of MHTN INTERNATIONAL, LLC.
1. Agreement to Terms
These Terms of Service ("Terms") constitute a binding agreement between you and MHTN INTERNATIONAL, LLC ("we," "us," or "our"), located at 280 S 400 W, Suite 250, Salt Lake City, Utah 84101, United States. 3. Website Use
- You must be at least 18 years old to submit information through this website.
- You agree to provide accurate information in forms and correspondence.
- You will not misuse this website — including attempting unauthorized access, disrupting operations, or submitting unlawful, defamatory, or deceptive material.
- Submitting a brief does not create a professional engagement, a professional-client relationship, or reliance rights.
4. Proposals and Engagement
- Professional services are performed only under written agreements specifying scope, schedule, deliverables, and fees.
- Proposals are valid for the period stated and may be revised if project information, site conditions, regulations, or scope change.
- Changes to agreed scope are documented in writing and may adjust fees and schedule.
5. Professional Standard of Care
- Services are performed with the care and skill ordinarily exercised by members of the profession practicing under similar conditions in the same locality.
- Unless expressly stated in a written agreement, no warranty or guarantee — express or implied — is made regarding professional services.
- Field observations, laboratory results, and survey data reflect conditions at the time and location of measurement; conditions may differ elsewhere or change over time.
6. Deliverables and Records
- Reports, drawings, maps, certificates, and other deliverables are prepared for the client's use on the specific project stated in the agreement.
- Reliance on deliverables by third parties requires our written consent and, where applicable, a reliance letter.
- Reproduction or use of deliverables for other projects or purposes without written authorization is prohibited.
7. Client Responsibilities
- Clients must provide accurate site information, access, records, and timely decisions required for the work.
- Clients are responsible for obtaining rights-of-entry and landowner permissions needed for fieldwork.
- Clients must disclose known hazards — buried utilities, contamination, unsafe structures — to the best of their knowledge before fieldwork begins.
8. Fees and Payment
- Fees — hourly, unit, lump-sum, or retainer — are established in each written agreement.
- Invoices are due per agreement terms; late payment may suspend services and accrue interest.
- Reimbursable expenses, laboratory media, and field logistics are billed as specified in the agreement.
9. Intellectual Property
All content on this website — text, graphics, diagrams, layout, and design — is owned by or licensed to MHTN INTERNATIONAL, LLC and protected by intellectual-property law. Instruments of professional service (drawings, reports, maps, specifications) are governed by the applicable written agreement and remain our property unless expressly transferred. You may view and print website pages for personal, non-commercial use only.
10. Third-Party Links
